PORTLAND — A Lisbon man admitted Monday to having child pornography.
Joseph Gibson, 36, pleaded guilty in U.S. District Court to the felony charge that is punishable by 10-20 years in prison and a fine of up to $250,000.
After serving any prison time a judge might impose, Gibson could be sentenced to supervised release from five years to life.
Prosecutors have recommended a 10-year prison sentence.
On Monday, Gibson waived his right to appeal any sentence of 10 years or less.
Gibson also waived forfeiture of property seized by federal agents during the execution of the search warrant.
Assistant U.S. Attorney Sheila Sawyer wrote in court documents that, had the case gone to trial, she would have presented evidence and witnesses who would have testified that on Dec. 11, 2023, Maine State Police executed a search warrant at Gibson’s home on Ridge Road in Lisbon.
Police had earlier identified an IP address at that home that was responsible for downloading child pornography in September and October 2023 by using a certain type of software.
While the warrant was being executed, Gibson was interviewed by police. He admitted to having viewed child pornography on the internet, Sawyer wrote.
Police analyzed two electronic devices, including a Samsung tablet and a ZTE cellphone with a SIM card, that had been found in Gibson’s home and that contained child pornography.
The case was referred to Homeland Security Investigations, which conducted a follow-up review of the devices that were seized, Sawyer wrote.
That federal agency found five video files depicting the sexual abuse of young children in a folder on Gibson’s cellphone, which had been made in China, and all of the videos depicted prepubescent minors or minors who had not yet reached the age of 12.
Gibson had been convicted twice of crimes relating to the possession and distribution of child pornography, Sawyer wrote.
In January 2010, Gibson was convicted in Androscoggin County Superior Court in Auburn of possession of sexually explicit material of a minor under 12. He was incarcerated for that crime.
In December 2011, Gibson was convicted in the same court in Auburn of dissemination of sexually explicit material of a minor under 12 after having previously been convicted of possessing sexually explicit material of a minor and possession of sexually explicit material of a minor under 12.
He was again sentenced to time behind bars.
On Monday, Gibson appeared in federal court wearing a blue jail suit while handcuffed and shackled.
He will remain in custody pending his sentencing on the federal charge, U.S. District Court Judge Nancy Torresen said Monday.
Gibson’s sentencing is expected to be scheduled after the U.S. Probation and Parole Office has completed its background report on him.
